FunGog App – Terms of Use

These Terms of Use ("Terms") govern your access to and use of the FunGog mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Scope

These Terms apply only to the FunGog Android application. They do not apply to the FunGog website, which is governed by separate terms and policies.

3. No Accounts & Anonymous Use

The App does not require account registration. We do not collect user names or email addresses.

The App uses anonymous identifiers (such as a Firebase Installation ID) to:

• Enable app functionality
• Enforce usage limits and token rules
• Prevent abuse

4. Tokens, Usage Limits & Purchases

The App may provide:

• Free tokens for first-time users
• Paid tokens available through in-app purchases

Important Token Rules

• Tokens have no cash value
• Token balances may be affected by technical issues, updates, or misuse
• We do not guarantee the availability, accuracy, or persistence of token balances

No Refunds

5. AI-Generated Content Disclaimer

The App uses automated and AI-based systems to generate stories, facts, and responses.

You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, fictional, or misleading
• Content is provided only for general informational purposes
• The content must not be relied upon as factual, legal, medical, or professional advice
• Use of AI-generated content is at your own risk

6. Camera & User Content Responsibility

The App allows users to capture images using their device camera.

You are solely responsible for:

• Images you capture or submit
• Ensuring captured content complies with applicable laws
• Respecting third-party rights, including copyright and privacy

We do not monitor user-captured images and are not responsible for unlawful or improper use of the camera feature.

7. Service Availability & Changes

We reserve the right to:

• Modify or discontinue any part of the App
• Change features, limits, or token rules
• Suspend or restrict access for misuse or abuse

Such changes may occur without prior notice.

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

• Accuracy or reliability of content
• Availability or uninterrupted operation
• Fitness for a particular purpose

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• FunGog shall not be liable for any indirect, incidental, special, or consequential damages
• We are not responsible for loss of tokens, data, content, or usage history
• We are not responsible for any damage to your device, software, or data resulting from use of the App

10. Intellectual Property

All intellectual property rights in the App, including software, text, branding, and design, belong to FunGog or its licensors.

You may not copy, modify, reverse engineer, or distribute the App without permission.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the place where the App operator is established, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
